1. Introduction

1.1  PRNV Services (“PRNV Services”, “the Platform”, “we”, “us” or “our”) operates an integrated technology-enabled platform that connects customers with independent service professionals and businesses across a range of service categories. PRNV Services respects the intellectual property rights of others and is firmly committed to ensuring that its digital platforms are not used to infringe the copyrights, trademarks, or other proprietary rights of any individual or organisation.

1.2  This Copyright & Intellectual Property Infringement Policy (the “Policy”) sets out the framework through which PRNV Services receives, reviews, and responds to complaints concerning alleged intellectual property infringement on its platforms, and the manner in which content that reasonably appears to infringe such rights may be restricted, disabled, or removed.

1.3  This Policy is published as Version 1.0 Final Website Content and is intended to be read together with the Terms & Conditions, Privacy Policy, Acceptable Use Policy, and other policies of PRNV Services, each of which forms part of the overall governance framework applicable to the use of the Platform.

1.4  By accessing, browsing, registering on, or using any website, mobile application, customer portal, or digital service operated by PRNV Services, every user, service professional, business partner, and visitor acknowledges and agrees to comply with this Policy and to respect the intellectual property rights of PRNV Services and of all third parties.

Voluntary Adoption of a DMCA-Style Framework

Although the Digital Millennium Copyright Act (“DMCA”) is a statute of the United States of America and does not, of itself, govern the operations of PRNV Services, PRNV Services has voluntarily adopted a DMCA-style notice-and-takedown framework as an internationally recognised best-practice mechanism for handling copyright and intellectual property complaints.

This framework is applied where appropriate and in a manner consistent with applicable Indian law, including the Copyright Act, 1957, the Trade Marks Act, 1999, the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Nothing in this Policy shall be construed as submitting PRNV Services to the jurisdiction of any foreign statute.

2. Purpose of this Policy

The purpose of this Policy is to establish a clear, fair, and transparent framework that enables PRNV Services to:

•     Affirm PRNV Services’ respect for, and commitment to, the protection of intellectual property rights;

•     Provide rights holders with an accessible and structured channel through which to report alleged infringement of their copyrights, trademarks, and other proprietary rights;

•     Set out the information required for an infringement notice to be reviewed and acted upon promptly;

•     Describe the verification, review, notice-and-takedown, and counter-notification procedures applied by PRNV Services;

•     Define the responsibilities of users, service professionals, and PRNV Services in maintaining a lawful and rights-respecting digital environment;

•     Establish a fair process that balances the legitimate interests of rights holders with the rights of users to contest unjustified or mistaken complaints; and

•     Promote responsible digital content governance, transparency, and continuous improvement of intellectual property compliance practices.

3. Scope and Applicability

3.1  This Policy applies to all digital platforms, properties, and services owned, operated, controlled, or made available by PRNV Services, including, without limitation:

•     the PRNV Services website at www.prnvservices.com and all associated web pages and sub-domains;

•     all PRNV Services mobile applications across operating systems and devices;

•     customer portals, dashboards, and account interfaces;

•     online services, listing pages, and search and discovery features;

•     user profiles and service-professional profiles;

•     reviews, ratings, and feedback systems;

•     messaging and communication features;

•     community, social, and other interactive features; and

•     all digital content and technology platforms operated by or on behalf of PRNV Services.

3.2  This Policy applies to all persons and entities who access or use the Platform in any capacity, including customers and users, independent service professionals and businesses, business partners, copyright owners and rights holders, regulatory authorities, and general website visitors.

3.3  This Policy governs content uploaded, published, transmitted, stored, displayed, or otherwise made available on or through the Platform, whether such content originates from PRNV Services, from users, from service professionals, or from third parties.

3.4  Where any provision of this Policy conflicts with a mandatory requirement of applicable law, the requirement of law shall prevail, and the remaining provisions of this Policy shall continue in full force and effect.

4. Definitions

For the purposes of this Policy, the following terms shall have the meanings set out below. Terms not defined here shall have the meanings ascribed to them in the Terms & Conditions of PRNV Services or under applicable law.

“Complainant” / “Rights Holder”

any individual or entity that submits an infringement notice asserting ownership of, or authority to act on behalf of the owner of, an intellectual property right alleged to have been infringed.

“Content”

any text, graphics, images, photographs, designs, logos, audio, video, software, data, databases, listings, reviews, messages, or other material uploaded, published, transmitted, displayed, or stored on or through the Platform.

“Counter-Notice”

a formal response submitted by a user or service professional contesting the removal or restriction of Content alleged to be infringing.

“Infringement Notice” / “Takedown Notice”

a complaint submitted in accordance with this Policy alleging that specific Content infringes an intellectual property right.

“Intellectual Property Rights”

copyrights, trademarks, service marks, trade names, logos, brand assets, designs, patents, trade secrets, database rights, and all other proprietary rights recognised under applicable law.

“Service Professional”

any independent technician, professional, vendor, or business entity that lists, advertises, or offers services through the Platform.

“User”

any person who accesses or uses the Platform, including customers, visitors, and registered account holders.

“User-Generated Content”

any Content created, uploaded, or submitted by users or service professionals, as distinct from Content owned or created by PRNV Services.

“IP Officer”

the Copyright and Intellectual Property Officer designated by PRNV Services to receive and process notices under this Policy.

5. Nature of Platform Services

5.1  PRNV Services operates as a technology-enabled intermediary and platform that facilitates connections between customers and independent service professionals. PRNV Services provides advertising, listing, visibility, discovery, and communication features that enable service professionals to present their services and enable customers to find and engage with them.

5.2  A significant proportion of the Content available on the Platform is User-Generated Content, including profile information, listings, descriptions, images, reviews, ratings, and messages submitted by users and service professionals. PRNV Services does not author, and cannot independently verify the ownership or originality of, all such User-Generated Content.

5.3  In its capacity as an intermediary, PRNV Services hosts and transmits Content provided by third parties. This Policy reflects the manner in which PRNV Services discharges its responsibilities in good faith in relation to such Content, consistent with the obligations applicable to intermediaries under the Information Technology Act, 2000 and the rules made thereunder.

6. Commitment to Intellectual Property Protection

PRNV Services is committed to the protection of intellectual property rights and to maintaining a digital environment in which creativity, originality, and lawful ownership are respected. In furtherance of this commitment, PRNV Services undertakes to:

•     respect the intellectual property rights of all individuals, creators, businesses, and rights holders;

•     promptly and impartially review properly submitted infringement notices;

•     apply fair and reasonable notice-and-takedown procedures;

•     provide affected users with a meaningful opportunity to submit a counter-notification where appropriate;

•     cooperate with lawful investigations and comply with legal requirements;

•     protect the interests of creators and legitimate rights holders; and

•     continuously improve its intellectual property governance practices.

7. Intellectual Property Rights Covered

This Policy addresses the protection of a broad range of intellectual property rights belonging to PRNV Services and to third parties, including the following categories.

7.1  Copyrights

Original works of authorship protected under the Copyright Act, 1957 and applicable international principles, including literary, artistic, musical, dramatic, photographic, audiovisual, and software works, whether published or unpublished.

7.2  Trademarks

Registered and unregistered trademarks, service marks, trade names, and other source identifiers protected under the Trade Marks Act, 1999, including the marks “PRNV” and “PRNV Services” and any associated marks of PRNV Services and of third parties.

7.3  Logos and Brand Assets

Logos, brand names, taglines, design marks, colour schemes, visual identities, and other brand assets that distinguish the goods or services of PRNV Services or of any third party.

7.4  Text, Graphics, Images, and Designs

Written content, illustrations, graphics, photographs, icons, layouts, user-interface designs, and other visual or textual materials displayed on the Platform.

7.5  Audio and Video Content

Sound recordings, music, voiceovers, podcasts, films, animations, promotional videos, and other audio and audiovisual materials.

7.6  Software and Databases

Source code, object code, application software, scripts, algorithms, business logic, compilations, and databases, together with their structure, arrangement, and selection of contents.

7.7  User-Generated Content

Content created and submitted by users and service professionals, including profiles, listings, descriptions, reviews, ratings, images, and messages, in respect of which the contributing user or service professional warrants that they hold the necessary rights.

7.8  Proprietary Materials and Documentation

Manuals, guides, templates, policies, training materials, technical documentation, and other proprietary materials produced by or for PRNV Services.

8. Respect for Third-Party Intellectual Property Rights

8.1  PRNV Services expects every user, service professional, and business partner to respect the intellectual property rights of others and to ensure that any Content they upload, publish, share, or transmit through the Platform does not infringe the rights of any third party.

8.2  By submitting Content to the Platform, each user and service professional represents and warrants that they own the Content or have obtained all rights, licences, consents, and permissions necessary to submit it, and that the Content does not infringe the intellectual property or other rights of any third party.

8.3  PRNV Services does not claim ownership of User-Generated Content. However, to operate the Platform, PRNV Services may require a limited licence to host, display, reproduce, and distribute such Content for the purpose of providing its services, as set out in its Terms & Conditions.

9. Prohibited Activities

The following activities are strictly prohibited on all platforms operated by PRNV Services. Engaging in any such activity may result in restriction, suspension, or removal of Content and of the offending account.

9.1  Unauthorized Copying or Reproduction

Copying, reproducing, scanning, screenshotting, or otherwise duplicating any protected Content without the authorisation of the rights holder.

9.2  Unauthorized Distribution or Publication

Distributing, publishing, transmitting, broadcasting, or making available any protected Content without lawful authority.

9.3  Uploading or Sharing Infringing Content

Uploading, posting, sharing, or hosting Content that infringes, or is reasonably likely to infringe, the copyright, trademark, or other intellectual property rights of any person.

9.4  Circumvention of Intellectual Property Protections

Circumventing, disabling, or interfering with any technological measure, access control, watermark, or rights-management mechanism used to protect intellectual property.

9.5  Misrepresentation of Ownership Rights

Falsely claiming ownership of, or authority over, Content, or submitting infringement notices or counter-notices in bad faith or with materially false information.

9.6  Removal or Alteration of Copyright Notices

Removing, obscuring, altering, or falsifying any copyright notice, trademark notice, attribution, watermark, or other proprietary marking.

9.7  Any Other Intellectual Property Violations

Engaging in any other act that violates the intellectual property rights of PRNV Services or of any third party, or that otherwise contravenes applicable intellectual property law.

10. Copyright Complaint Submission Procedures

10.1  Any rights holder who believes in good faith that Content available on the Platform infringes their intellectual property rights may submit an Infringement Notice to the Copyright and Intellectual Property Officer of PRNV Services.

10.2  Submission Channels. Infringement Notices may be submitted through the channels designated in the Contact Information section of this Policy, including by email to the designated address and by written communication to the registered business address. PRNV Services may, from time to time, provide additional online submission forms or reporting tools.

10.3  To enable prompt review, an Infringement Notice should be clearly identified as a copyright or intellectual property complaint and should contain all of the information set out in Section 11 below.

10.4  Incomplete notices may delay review. PRNV Services may contact the Complainant to request additional information necessary to evaluate the complaint.

11. Information Required in an Infringement Notice

To be actionable, an Infringement Notice should include the following information, consistent with internationally recognised notice-and-takedown principles:

•     the name, postal address, telephone number, and email address of the Complainant;

•     a clear identification of the copyrighted work, trademark, or other intellectual property right claimed to have been infringed;

•     a clear identification of the allegedly infringing Content, including the specific URL(s), listing reference, profile, or location on the Platform sufficient to enable PRNV Services to locate it;

•     a statement that the Complainant has a good-faith belief that the use of the Content is not authorised by the rights holder, its agent, or applicable law;

•     a statement that the information in the notice is accurate, and that the Complainant is the owner of the right or is authorised to act on the owner’s behalf;

•     evidence or documentation supporting the claim of ownership or authority, where available; and

•     the physical or electronic signature of the Complainant or of the person authorised to act on the rights holder’s behalf.

Good-Faith Requirement

Knowingly submitting a false, misleading, or bad-faith Infringement Notice or Counter-Notice is prohibited and may result in the rejection of the submission, suspension of platform access, and any other action available to PRNV Services or to affected parties under applicable law.

12. Verification and Review Procedures

12.1  Upon receipt of an Infringement Notice, the IP Officer will acknowledge the complaint and undertake a preliminary review to determine whether it contains the information required under this Policy.

12.2  PRNV Services will review each properly submitted notice in good faith, impartially, and within a reasonable period, having regard to the nature and complexity of the complaint and to any applicable legal timelines.

12.3  PRNV Services may, where appropriate, seek clarification or further information from the Complainant, and may review the identified Content and surrounding circumstances to assess whether it reasonably appears to infringe an intellectual property right.

12.4  PRNV Services does not adjudicate disputed questions of legal ownership and does not act as a court or tribunal. Its review is limited to determining whether Content reasonably appears to infringe rights or to violate this Policy, and to applying the procedures set out herein.

13. Notice and Takedown Procedures

13.1  Where, following review, Content reasonably appears to infringe an intellectual property right or to violate this Policy, PRNV Services may remove, restrict, disable access to, or otherwise act upon the Content.

13.2  PRNV Services may, in appropriate cases, take expeditious action to temporarily restrict or disable access to disputed Content pending completion of its review, in order to limit potential harm to rights holders.

13.3  Where reasonably practicable and permitted by law, PRNV Services will notify the user or service professional whose Content has been removed or restricted, and will provide information regarding the basis for the action and the availability of the counter-notification procedure.

13.4  PRNV Services voluntarily applies these DMCA-style notice-and-takedown procedures as a best-practice mechanism, where appropriate and consistent with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian law.

14. Counter-Notification Procedures

14.1  A user or service professional who believes that their Content was removed or restricted as a result of a mistake or misidentification may submit a Counter-Notice to the IP Officer.

14.2  A Counter-Notice should include: (a) the name, address, telephone number, and email address of the submitting party; (b) identification of the Content that was removed or restricted and its location prior to removal; (c) a statement, made in good faith, that the Content was removed as a result of mistake or misidentification; (d) a statement that the submitting party holds the necessary rights in the Content or is otherwise entitled to use it; and (e) the physical or electronic signature of the submitting party.

14.3  Upon receipt of a valid Counter-Notice, PRNV Services may review the matter and, where it considers appropriate, restore the Content or maintain its removal pending resolution. PRNV Services may, where relevant, forward the Counter-Notice to the original Complainant.

14.4  The counter-notification process provides a fair opportunity for affected parties to contest removals. PRNV Services reserves the right to decline to restore Content where doing so would, in its reasonable assessment, expose PRNV Services or any third party to legal risk or would contravene applicable law.

15. Repeat Infringement Policy

15.1  PRNV Services maintains a policy of taking action against repeat infringers. A user or service professional who is the subject of repeated, substantiated infringement complaints may have their Content removed, their access restricted, or their account suspended or terminated.

15.2  In determining whether a person is a repeat infringer, PRNV Services may consider the number, nature, and substantiation of complaints received, the conduct of the person concerned, and any pattern of behaviour indicating a disregard for the intellectual property rights of others.

15.3  PRNV Services reserves the right to take action against repeat infringement in appropriate circumstances and at its reasonable discretion, consistent with this Policy and applicable law.

16. Content Restriction, Suspension, and Removal Procedures

16.1  PRNV Services may, at its reasonable discretion and consistent with this Policy, restrict, suspend, disable, or remove any Content that reasonably appears to infringe intellectual property rights or to violate this Policy or the Terms & Conditions of the Platform.

16.2  Action taken may include the temporary restriction of disputed Content pending review, the permanent removal of confirmed infringing Content, the disabling of associated links or listings, and the suspension or termination of the responsible account in cases of serious or repeated infringement.

16.3  Where reasonably practicable, PRNV Services will provide affected users with notice of such action and information regarding the procedures available to contest it, except where prohibited by law or where immediate action is necessary to prevent harm.

17. Preservation of Records and Evidence

17.1  PRNV Services may retain records of Infringement Notices, Counter-Notices, related communications, and the actions taken in response, for such period as it considers appropriate and as required under applicable law.

17.2  Where required to do so by law, or where reasonably necessary to support a lawful investigation, to protect its rights, or to comply with a binding order, PRNV Services may preserve relevant Content, metadata, and evidence relating to alleged infringement.

17.3  The preservation of records under this Section shall be undertaken in a manner consistent with the Privacy Policy of PRNV Services and applicable data-protection law, including the Digital Personal Data Protection Act, 2023.

18. Responsibilities of Users

Users of the Platform are responsible for ensuring that their conduct and any Content they submit comply with this Policy. In particular, users shall:

•     respect the intellectual property rights of PRNV Services and of all third parties;

•     submit only Content that they own or are authorised to use;

•     refrain from engaging in any of the prohibited activities set out in Section 9;

•     promptly report any suspected infringement of which they become aware; and

•     cooperate reasonably with any review or investigation conducted under this Policy.

19. Responsibilities of Service Professionals

Service professionals and businesses that list or advertise on the Platform bear particular responsibility for the Content associated with their profiles and listings. Each service professional shall:

•     ensure that all business names, logos, images, descriptions, and other listing Content are owned by them or used with proper authorisation;

•     refrain from using the trademarks, logos, brand assets, or copyrighted materials of others without lawful authority;

•     ensure that any reviews, certifications, or representations displayed are genuine and lawful;

•     respond promptly to any notice concerning alleged infringement relating to their Content; and

•     indemnify PRNV Services, to the extent permitted by law and as set out in the applicable agreement, against claims arising from Content they submit.

20. Responsibilities of PRNV Services

In the administration of this Policy, PRNV Services undertakes to:

•     maintain accessible channels for the submission of infringement notices and counter-notices;

•     review properly submitted notices in good faith and within a reasonable period;

•     apply fair, reasonable, and consistent notice-and-takedown procedures;

•     provide affected users with a meaningful opportunity to submit counter-notifications where appropriate;

•     act transparently and proportionately in restricting or removing Content; and

•     continuously review and improve its intellectual property governance practices.

Disclaimer

PRNV Services respects intellectual property rights and expects all users to do the same.

PRNV Services may remove, restrict, or disable access to any Content that reasonably appears to infringe intellectual property rights or to violate this Policy, at its reasonable discretion and consistent with applicable law.

PRNV Services does not independently verify the ownership of all User-Generated Content. Users and service professionals remain solely responsible for the Content they upload, publish, or share, and for ensuring that such Content does not infringe the rights of any third party.

21. Cooperation with Rights Holders, Regulatory Authorities, and Law Enforcement

21.1  PRNV Services is committed to cooperating with legitimate rights holders, regulatory authorities, and law-enforcement agencies in addressing intellectual property infringement, in accordance with applicable law.

21.2  PRNV Services may, where lawfully required or where reasonably appropriate to protect its rights or those of third parties, disclose relevant information, preserve evidence, or take other action in response to valid legal requests, court orders, or directions of competent authorities.

21.3  Cooperation under this Section shall be undertaken in a manner consistent with the Privacy Policy of PRNV Services and the confidentiality considerations set out in Section 22.

22. Privacy and Confidentiality Considerations

22.1  Personal information submitted as part of an Infringement Notice or Counter-Notice will be processed in accordance with the Privacy Policy of PRNV Services and applicable data-protection law, including the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.

22.2  PRNV Services may share the contents of a notice, including the identity of the Complainant, with the user or service professional whose Content is the subject of the complaint, to the extent reasonably necessary to process the complaint and to enable a counter-notification.

22.3  PRNV Services will take reasonable measures to handle information received under this Policy responsibly and to limit its use to the purposes of administering this Policy and complying with applicable law.

23. Compliance Monitoring and Periodic Reviews

23.1  PRNV Services is committed to the continuous improvement of its intellectual property governance and will monitor the operation of this Policy to assess its effectiveness.

23.2  This Policy will be reviewed periodically, and as required to reflect changes in applicable law, regulatory guidance, industry best practice, or the operations of the Platform.

23.3  PRNV Services may adopt additional tools, processes, and safeguards from time to time to strengthen the detection, prevention, and remediation of intellectual property infringement.

24. Amendments and Updates

24.1  PRNV Services reserves the right to amend, modify, supplement, or update this Policy at any time at its reasonable discretion, in order to maintain compliance with applicable law and to reflect best practice.

24.2  Updated versions of this Policy will be published on the Platform and will take effect upon publication, unless a later effective date is specified. The version number and review date will be updated accordingly.

24.3  Continued use of the Platform after the publication of an updated Policy constitutes acceptance of the updated Policy.

25. Governing Law and Jurisdiction

25.1  This Policy is governed by and shall be construed in accordance with the laws of the Republic of India, including the Copyright Act, 1957, the Trade Marks Act, 1999, the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and other applicable statutes, rules, and regulations in force from time to time.

25.2  Subject to any applicable dispute-resolution provisions in the Terms & Conditions of PRNV Services, the courts at Hyderabad, Telangana, India shall have exclusive jurisdiction over any dispute arising out of or in connection with this Policy.

25.3  The voluntary adoption of a DMCA-style framework does not subject PRNV Services to the jurisdiction of any foreign law, and this Policy shall be interpreted consistently with applicable Indian law.
