3.  Scope and Applicability

3.1   This Policy applies to all digital platforms and communication channels operated, controlled, or authorised by PRNV Services, including without limitation our website, mobile applications, customer portals, email communications, SMS communications, push notifications, in-application messaging, customer support channels, online services, and all associated communication systems and technology platforms.

3.2   This Policy applies to every person and entity that accesses, registers on, uses, or interacts with the Platform, including customers, registered users, service professionals, technicians, businesses, business partners, vendors, and general visitors (each, a “User”, and collectively, “Users”).

3.3   This Policy governs both (a) communications sent by, on behalf of, or through PRNV Services to Users; and (b) communications sent by Users to one another, or to PRNV Services, through any channel or feature made available on the Platform.

3.4   This Policy operates in addition to, and is to be read together with, the Privacy Policy, the Terms & Conditions, and all other policies published by PRNV Services. In the event of any conflict between this Policy and another policy specifically governing a particular subject matter, the policy more specific to that subject matter shall prevail to the extent of the conflict, while preserving the overall objective of preventing spam and communication abuse.

3.5   This Policy applies to the extent permitted by, and in a manner consistent with, applicable laws of the Republic of India, including the Information Technology Act, 2000 and the rules framed thereunder, the Digital Personal Data Protection Act, 2023, and applicable regulations governing commercial and electronic communications.

4.  Definitions

For the purposes of this Policy, the following terms shall have the meanings set out below, unless the context requires otherwise:

“Platform” means the website, mobile applications, customer portals, online services, and associated communication systems and technology platforms operated by PRNV Services, accessible at www.prnvservices.com.

“User” means any customer, registered user, service professional, technician, business, business partner, vendor, or visitor who accesses, uses, or interacts with the Platform.

“Service Professional” means any independent technician, skilled professional, business, or entity that lists, advertises, or offers services through the Platform.

“Transactional Communication” means a communication necessary to facilitate, confirm, support, or complete an action, request, or interaction initiated by or relating to a User, including one-time passwords, account and security notifications, booking-related updates, and service confirmations.

“Service-Related Communication” means a communication relating to the functioning, support, security, or administration of the Platform or a User’s account.

“Promotional Communication” means a communication intended to promote, advertise, or inform a User about features, updates, or offerings, which is sent on the basis of applicable consent and subject to opt-out controls.

5.3   Effective and trustworthy communication is therefore integral to the nature of the services provided. PRNV Services is committed to ensuring that communications sent through the Platform are relevant, lawful, respectful of User preferences, and free from spam, deception, and abuse.

7.  Principles of Anti-Spam Compliance

PRNV Services structures its communication practices around the following core principles:

7.1  Consent and Lawful Basis.   Non-essential communications are sent only on the basis of valid consent or another lawful basis recognised under applicable law. Essential, transactional, service-related, security, and legally required communications may be sent where necessary and permitted.

7.2  Transparency.   Users are provided with clear information about the categories of communication they may receive and the means by which they may manage their preferences.

7.3  Relevance and Proportionality.   Communications are intended to be relevant, purposeful, and proportionate, and are not to be sent in an excessive, repetitive, or indiscriminate manner.

7.4  Choice and Control.   Users are given accessible opt-in and opt-out mechanisms and the ability to manage their communication preferences across channels.

8.1  Unsolicited Bulk Communications

The sending of unsolicited communications in bulk or mass volume to recipients who have not provided valid consent or who lack any prior relationship justifying such communication, including indiscriminate broadcasting of messages across the Platform’s channels.

8.2  Repetitive or Excessive Messages

The sending of repetitive, duplicative, or excessive messages that cause nuisance, harassment, or disruption to recipients, or that are intended to flood, overwhelm, or abuse a communication channel or recipient.

8.3  Misleading or Deceptive Communications

Communications containing false, misleading, deceptive, or inaccurate information, including misleading subject lines, headers, sender details, or content designed to deceive recipients as to the nature, source, or purpose of the communication.

8.4  Unauthorised Promotional Communications

Promotional or advertising communications sent without the requisite consent or lawful basis, or in violation of applicable communication regulations or this Policy, including the use of Platform channels to distribute unauthorised promotional content.

8.5  Phishing and Fraudulent Communications

Communications designed to fraudulently obtain sensitive information, credentials, financial details, or value, including phishing, smishing, deceptive links, or any communication that falsely purports to originate from PRNV Services or any other person or entity.

8.6  Impersonation and Misrepresentation

Communications that impersonate, or misrepresent an affiliation with, PRNV Services, its personnel, Users, service professionals, businesses, or any third party, or that falsify identity, authority, or origin in order to mislead recipients.

8.7  Malicious Links or Harmful Content

Communications that contain or distribute malicious links, malware, viruses, harmful code, fraudulent attachments, or any content designed to compromise the security, devices, accounts, or data of recipients or the Platform.

8.8  Automated Abuse and Communication Misuse

The use of bots, scripts, automated systems, or other technical means to generate, send, or amplify communications in a manner that abuses, circumvents, or overwhelms the Platform’s communication systems or controls.

8.9  Unwanted or Unauthorised Electronic Communications

Any other unwanted, unsolicited, or unauthorised electronic communication that is sent without valid consent or lawful basis, that disregards a recipient’s opt-out or communication preferences, or that otherwise contravenes this Policy or applicable law.

9.  Communication Consent Principles

9.1   PRNV Services obtains and relies upon consent for communications in a manner consistent with applicable law. Where consent is required for a particular category of communication, such consent is sought through clear, affirmative, and informed means.

9.2   Certain communications are essential to the operation of the Platform and the security of User accounts. Transactional, service-related, operational, security, and legally required communications may be sent where necessary and permitted by applicable law, irrespective of marketing preferences, because they are integral to the services requested by or provided to the User.

9.3   Promotional and other non-essential communications are sent only on the basis of valid consent and remain subject to the opt-out controls described in this Policy.

9.4   Users may withdraw consent to non-essential communications at any time. The withdrawal of consent will not affect the lawfulness of communications sent prior to such withdrawal, nor will it apply to essential transactional, security, or legally required communications.

10.3   PRNV Services endeavours to give effect to preference changes within a reasonable period. Users may continue to receive certain communications for a short transitional period while preference updates are processed across systems.

10.4   Opt-out and preference controls apply to non-essential communications. Essential transactional, service-related, security, and legally required communications may continue to be sent where necessary and permitted by applicable law.

12.2   Transactional and service-related messages — including one-time passwords, security alerts, verification messages, and booking or service updates — are sent to deliver and secure the services and may be sent where necessary and permitted, including in accordance with applicable regulatory frameworks for transactional communications.

12.3   Promotional or non-essential SMS and notification communications are sent on the basis of applicable consent and remain subject to opt-out and preference controls.

12.4   Users may manage push notifications through the settings of their device or application and may manage other notification preferences through the controls described in this Policy. The delivery of SMS and certain notifications depends on telecom networks, device settings, and third-party infrastructure that are outside the control of PRNV Services.

13.  Responsible Use of Communication Channels

13.1   All communication channels and features made available on the Platform must be used responsibly, lawfully, and solely for their intended purposes.

13.2   Users must not use any Platform channel — including messaging, support, profile, or notification features — to send spam, unsolicited bulk communications, deceptive or fraudulent messages, malicious content, or any communication prohibited under this Policy.

13.3   Users must not employ automated tools, bots, or scripts to misuse, overwhelm, or circumvent communication systems or controls, nor attempt to bypass opt-out, preference, or security mechanisms.

13.4   PRNV Services reserves the right to monitor, filter, restrict, or disable communication features, to the extent permitted by applicable law, where necessary to prevent spam, abuse, or misuse and to protect Users and the integrity of the Platform.

14.  User Responsibilities

Every User of the Platform is responsible for ensuring that their use of communication channels is lawful, respectful, and consistent with this Policy. In particular, Users shall:

•      use communication features only for legitimate and lawful purposes and refrain from sending spam, unsolicited bulk, or prohibited communications;

•      respect the communication preferences, consent choices, and privacy of other Users;

•      refrain from impersonation, misrepresentation, phishing, fraud, or the distribution of malicious links or harmful content;

•      keep account credentials secure and not allow their account or channels to be used for spam or abusive communications;

•      maintain accurate contact details and promptly update communication preferences as needed;

•      promptly report any spam, abuse, or suspicious communication that they receive or observe; and

•      comply with this Policy, the Terms & Conditions, the Privacy Policy, and all applicable laws.

15.  Service Professional Responsibilities

Service professionals, technicians, and businesses that use the Platform bear additional responsibility for the communications they send through or in connection with the Platform. In particular, they shall:

•      communicate with Users professionally, honestly, and only for legitimate, service-related purposes;

•      not send unsolicited bulk, repetitive, deceptive, or unauthorised promotional communications to Users;

•      obtain any consent required before sending non-essential communications and honour all opt-out and preference choices;

•      not engage in impersonation, misleading claims, phishing, fraud, or the sharing of malicious links or harmful content;

•      not use automated tools or scripts to misuse Platform communication channels;

•      safeguard any User contact information accessed through the Platform and use it only for legitimate, permitted purposes; and

•      comply with this Policy, applicable agreements, and all applicable communication and data-protection laws.

16.  Responsibilities of PRNV Services

PRNV Services commits, on a reasonable-effort basis and consistent with applicable law, to:

•      design and operate its communication systems in a responsible, transparent, and lawful manner;

•      send communications based on valid consent or another lawful, operational, transactional, security, or legally required basis;

•      provide accessible mechanisms for Users to manage preferences and opt out of non-essential communications;

•      implement reasonable technical and organisational measures to prevent, detect, and address spam, abuse, and fraudulent communications;

•      provide channels for Users to report spam, abuse, or suspicious communications and to review such reports promptly;

•      take appropriate corrective and preventive measures where misuse is identified; and

•      review and improve its communication-governance practices on a periodic basis.

17.  Reporting Spam, Abuse, or Suspicious Communications

17.1   PRNV Services encourages all Users to promptly report any communication that they believe to be spam, abusive, deceptive, fraudulent, or otherwise in breach of this Policy, including communications that falsely claim to originate from PRNV Services.

17.2   Reports may be submitted through the reporting or support features available on the Platform, or by contacting the Communications Compliance Officer using the details set out in the Contact Information section of this Policy.

17.3   To assist in the review of a report, Users are encouraged to provide relevant information, including the nature of the communication, the channel through which it was received, the date and time, the sender details (where available), and any supporting evidence such as screenshots or message content. Users should avoid interacting with suspicious links or attachments and should not share sensitive credentials.

17.4   PRNV Services treats reports seriously and endeavours to acknowledge and review valid reports within a reasonable period. Reports may be used to inform investigations, improve safeguards, and strengthen communication controls.

18.  Investigation and Review Procedures

18.1   Upon receiving a report or otherwise identifying a potential breach of this Policy, PRNV Services may undertake a review or investigation proportionate to the nature and seriousness of the matter.

18.2   Investigation activities may include reviewing relevant communication records, account activity, technical logs, and reported content; assessing patterns of communication; and, where appropriate, seeking additional information from the relevant Users.

18.3   Investigations are conducted with due regard for privacy, confidentiality, fairness, and applicable law. Information accessed in the course of an investigation is handled in accordance with the Privacy Policy and used only for legitimate purposes connected with the investigation, prevention of abuse, security, compliance, or the protection of Users and the Platform.

18.4   PRNV Services may, where appropriate and lawful, cooperate with telecom providers, communication-service partners, regulatory authorities, and law-enforcement agencies in connection with the investigation of spam, fraud, or communication abuse.

19.  Corrective and Preventive Measures

Where a breach of this Policy is identified or reasonably suspected, PRNV Services may take appropriate corrective and preventive measures, proportionate to the circumstances and consistent with applicable law, including:

•      issuing warnings, notices, or guidance to the responsible User;

•      filtering, blocking, removing, or restricting the offending communications or content;

•      restricting, suspending, or disabling access to particular communication features;

•      strengthening filters, controls, and safeguards to prevent recurrence;

•      temporarily or permanently restricting, suspending, or terminating accounts engaged in serious or repeated misuse, in accordance with the applicable Terms & Conditions;

•      reporting unlawful activity to the appropriate authorities where required or permitted; and

•      taking such other reasonable measures as may be necessary to protect Users and the integrity of communication channels.

20.  Temporary Restrictions and Communication Controls

20.1   To protect Users and the integrity of its communication channels, PRNV Services may apply temporary restrictions or communication controls where spam, abuse, or misuse is suspected, identified, or being investigated.

20.2   Such measures may include temporarily limiting the rate or volume of communications, pausing or disabling particular communication features, applying additional verification or security checks, or temporarily restricting access to messaging functionality.

20.3   Temporary restrictions are intended to be precautionary and proportionate. PRNV Services endeavours to apply them for no longer than reasonably necessary and to restore normal functionality once the relevant concern has been addressed, subject to the outcome of any investigation.

20.4   The application of temporary restrictions is without prejudice to any further corrective, preventive, or enforcement action that PRNV Services may take under this Policy or the applicable Terms & Conditions.

21.  Security and Fraud Prevention Measures

21.1   PRNV Services implements reasonable technical and organisational measures designed to protect its communication channels against unauthorised access, spam, phishing, fraud, impersonation, and the distribution of malicious content.

21.2   These measures may include filtering and monitoring systems, authentication and verification mechanisms, rate and volume controls, anomaly and abuse detection, secure transmission practices, and access controls, applied in a manner consistent with applicable law.

21.3   PRNV Services may use automated tools and analytics to detect and prevent communication abuse. Such tools are deployed to safeguard Users and the Platform, and are operated consistently with the Privacy Policy.

21.4   Notwithstanding these measures, no communication system can be guaranteed to be entirely secure or free from misuse by third parties. PRNV Services encourages Users to remain vigilant, to verify the authenticity of communications, and to report any suspicious activity promptly.

22.  Record Retention and Documentation

22.1   PRNV Services maintains appropriate records and documentation relating to communications, consent and preference choices, reports of spam or abuse, investigations, and corrective actions, to the extent appropriate and as required to operate the Platform and demonstrate compliance with applicable law.

22.2   Such records are retained for as long as necessary for the purposes for which they were created, including operational, security, dispute-resolution, audit, and regulatory purposes, or for such longer period as may be required under applicable law.

22.3   Records are stored securely and handled in accordance with the Privacy Policy and applicable data-protection requirements. On expiry of the applicable retention period, records are deleted, anonymised, or archived in accordance with applicable law and internal standards.

23.  Privacy and Confidentiality Considerations

23.1   The handling of personal data in connection with communications, preferences, reports, and investigations under this Policy is governed by the PRNV Services Privacy Policy and applicable data-protection law, including the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 and the rules framed thereunder.

23.2   Information accessed or processed in connection with this Policy is used only for legitimate purposes, including the prevention of spam and abuse, security, compliance, investigation, and the protection of Users and the Platform.

23.3   PRNV Services treats reports, investigation details, and related information with appropriate confidentiality, disclosing such information only where necessary for the purposes described in this Policy, where required to give effect to corrective action, or where required or permitted by applicable law.

23.4   Nothing in this Policy limits the rights available to Users under the Privacy Policy or applicable data-protection law in respect of their personal data.

24.  Compliance Monitoring and Periodic Reviews

24.1   PRNV Services monitors compliance with this Policy on an ongoing basis and reviews the effectiveness of its communication controls and safeguards from time to time.

24.2   Monitoring may include reviewing communication patterns, reports of spam or abuse, the performance of filtering and security measures, and feedback from Users, in a manner consistent with applicable law and the Privacy Policy.

25.  Amendments and Updates

25.1   PRNV Services reserves the right to amend, revise, update, or replace this Policy from time to time, in its discretion and in accordance with applicable law, to reflect changes in its practices, technology, operations, or legal and regulatory requirements.
